These Terms govern your use of the Favela Experience website (favelaexperience.tours) and the booking of our tours. Our tours are operated directly by Favela Experience Turismo Local LTDA (CNPJ 26.248.405/0001-37), Av. Presidente João Goulart, 825, Vidigal, Rio de Janeiro – RJ, CEP 22452-000, Brazil. By booking a tour, you agree to these Terms.

1. About us and the service

Favela Experience is a tour operator. We design and run our own community-based experiences in Rio de Janeiro's favelas, led by our own guides. When you book, your contract is directly with Favela Experience as the provider of the experience.

2. Eligibility

You must be at least 18 years old and able to enter into a contract under Brazilian law. Minors may join a tour only when accompanied by a parent or legal guardian, who books on their behalf and is responsible for them throughout the experience. Some experiences carry a minimum age (our hikes are more physically demanding); the minimum age is noted on each experience page.

3. Bookings and prices

A booking is confirmed once payment is received through Stripe.
Prices are shown in Brazilian Reais (BRL) and are the final, all-inclusive amount for the experience. There are no hidden fees added at checkout.
Each experience has a limited group size, shown at checkout.

4. Payment

Payments are processed by Stripe (credit and debit cards). By providing your payment details you authorise us to charge the full booking amount at confirmation. We do not store card numbers; all card data is handled by Stripe (PCI-DSS Level 1).

5. Cancellations and refunds

Because you book online, you have a 7-day right of regret under Art. 49 of the Brazilian Consumer Protection Code (CDC): you may cancel within 7 days of purchase for a full refund, except where the tour date falls within those 7 days and the experience has already taken place.

Beyond that window, our standard policy applies, based on how far before the tour you cancel:

7 or more days before the tour: full refund
Between 2 and 7 days before: 50% refund
Less than 2 days before, or no-show: no refund
If we cancel: full refund or a free reschedule, your choice

Where a refund is reduced or unavailable, we may be able to reschedule you instead, subject to availability, just ask.

Refunds are made to the original payment method, typically within 5–10 business days. To request one, see our refund policy.

6. Conduct on tours

Follow your guide's instructions at all times. Favelas are living communities, not exhibits: respect residents and their privacy.
Photographing people requires their consent.
We may remove anyone whose conduct endangers themselves, the group, or community members; no refund is due in that case.
Illegal drug use and excessive alcohol are not permitted.

7. Safety, health, and your responsibilities

Our tours take place outdoors and on foot. They involve walking, stairs, uneven terrain, and, for the hikes, sustained uphill effort. We maintain safety standards and brief every group, and your safety on the tour also depends on you. By booking, you agree to:

follow your guide's instructions and the safety briefing;
wear suitable footwear and clothing, and choose an experience that matches your fitness and mobility (the hikes are physically demanding);
tell us in advance of any medical condition, pregnancy, allergy, or mobility need that may affect your participation;
take responsibility for your personal belongings during the tour.

We strongly recommend that all guests hold personal travel and medical insurance covering accidents, illness, and trip cancellation. Nothing in these Terms limits the rights guaranteed to you by the Brazilian Consumer Protection Code.

8. Changes or cancellation by us

For reasons of safety, severe weather, or other circumstances beyond our reasonable control (force majeure), we may change or cancel a tour. In that case we offer a full refund or a free reschedule, your choice. We may also suspend a booking where false information or fraudulent activity is involved.

9. Reviews

Reviews must be honest and based on your actual experience. We do not remove negative reviews unless they contain false statements of fact or breach these Terms.

10. Intellectual property

All website content (text, photos, logos) belongs to Favela Experience or is licensed to us. If you upload content to us (for example, a review or photo), you grant us a non-exclusive, royalty-free licence to display it in connection with our service. You keep ownership, and you should upload only content you have the right to use.

Photography on tours: our guides may take photos or video during a tour, which we may use to promote Favela Experience. If you prefer not to appear, tell your guide before the tour or email us, and we will not use identifiable images of you.

11. Liability

Our liability is governed by Brazilian law, including the Consumer Protection Code (CDC). As provided by the CDC, we are not liable for damage arising exclusively from the guest's own act or omission, from the act of a third party, or from events beyond our reasonable control (force majeure). We maintain reasonable safety standards for every experience we operate.

12. Governing law and forum

These Terms are governed by the laws of Brazil, and the Consumer Protection Code (CDC) applies to our relationship with you as a consumer. Nothing here removes the mandatory consumer protections of your country of residence, and you may bring a claim in the forum of your own domicile as permitted by the CDC.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

13. Changes

We will post any material change here and update the date above at least 15 days before it takes effect. Continued use after that date constitutes acceptance.
